Supreme Courtroom says wrongful loss of life lawsuit against Dallas officers can go forward

DALLAS - The high court will allow a wrongful dying lawsuit to proceed in opposition to town of Dallas and 4 law enforcement officials.

The family of a man who died in police custody in 2016 sued.

Tony Timpa called police for assist as he had a drug and psychological health disaster.

The city fought in opposition to releasing body digicam video and whit it did come out it was obvious why. It showed the officers mocking the dying man.

One had his knee on Timpa’s again and neck for practically 15 minutes and the medical expert mentioned that contributed to his loss of life.

The city of Dallas argued the officers are legally shielded from lawsuits.

The Supreme Court docket upheld a federal appeals court docket’s ruling that can enable the case to proceed.

"The decision signifies that the case can proceed to trial and that there will probably be no extra delays from any appellate courtroom. Also, the decision means that the Fifth Circuit did it right that their ruling concerning lethal drive will be the legislation of the land at least in Mississippi, Texas and Louisiana for as long as we know," said Geoff Henley, an attorney for Timpa’s household.

Those are the states lined by the Fifth Circuit Courtroom of Appeals ruling permitting the suit to proceed.

Three years in the past, the Dallas district legal professional dropped felony prices towards three of the officers.
